Private Healthcare Scheme

Since the publication of previous information we have discovered that the introduction of the £100 excess is not restricted to Bands 1-3 staff, but affects all employees who have this benefit including former IMC staff who have transferred in to Network Rail.

Despite what Network Rail are telling you, the change has not been formally consulted with TSSA, nor was our agreement on the proposal sought. We have written to Network Rail to complain of this fact, and to remind them of their obligation to undertake meaningful consultation and negotiations on such issues. Indeed, a meeting of the National Management Group Council was held on 23 February 2007 and this item was not placed on the agenda for discussion by Network Rail.

Furthermore, we have now discovered that Network Rail are refusing to hear grievances legitimately raised by staff on this subject. We believe this may be a breach of your statutory right to have a grievance heard under the Employment Act 2002 (Dispute Resolution) Regulations 2004. Therefore, if you raise a grievance and Network Rail refuse to hear it, you must contact your TSSA Regional Team or the TSSA Members Helpdesk on 0800 328 2673 for further advice.

We will continue to support members who wish to challenge this imposed change through the grievance procedure and are currently exploring additional ways of doing so. Meanwhile, we will continue to press Network Rail for a satisfactory solution to this situation and keep you advised of any further developments.
